1. Acceptance of Terms

By contacting Arcadia Asphalt Paving, requesting a quote, or engaging our services, you agree to these Terms and Conditions. If you do not agree, please do not use our services or this website. These terms apply to all services provided by Arcadia Asphalt Paving (arcadiaasphaltpaving.com).

2. Description of Services

Arcadia Asphalt Paving provides asphalt paving, sealcoating, parking lot maintenance, driveway paving, pothole repair, crack sealing, grading, concrete curbing, and related exterior paving and site work services in Arcadia, CA and surrounding communities.

All services are performed by our crew or by licensed subcontractors under our supervision. We reserve the right to decline any project at our discretion. Submission of a contact form or request for estimate does not create a contract or guarantee of service.

3. Estimates and Pricing

Estimates provided by Arcadia Asphalt Paving are based on the conditions observed at the time of the site visit. Estimates are not binding quotes until confirmed in a written contract or proposal signed by both parties.

Final pricing may change if site conditions differ from what was observed during the estimate visit - for example, if additional base damage, drainage issues, or access constraints are discovered once work begins. We will notify you of any material changes before proceeding.

We do not guarantee price matching with other contractors. Prices are based on our materials, labor, equipment, and project scope.

4. Scheduling and Cancellation

Scheduled work dates are confirmed in writing. We reserve the right to reschedule jobs due to weather conditions that would affect the quality of the work, including rain, extreme heat, or high winds. We will notify you as soon as possible if a reschedule is needed.

If you need to cancel or reschedule, please contact us at least 48 hours before the scheduled start date. Cancellations made with less than 48 hours notice may be subject to a cancellation fee to cover mobilization costs already incurred.

No-shows or properties that are inaccessible at the time of the scheduled visit may result in a trip charge.

5. Payment Terms

Payment terms are specified in the written proposal for each job. For most residential projects, a deposit may be required before work begins, with the balance due upon completion. Commercial projects may have different payment schedules as agreed in writing.

Accepted payment methods will be stated in your proposal. We reserve the right to charge interest on balances that remain unpaid past their due date at the maximum rate permitted by California law.

If collection action becomes necessary, the customer agrees to pay all reasonable collection costs, including attorney fees, to the extent permitted by law.

6. Customer Responsibilities

You are responsible for ensuring that the work area is accessible to our crew and equipment on the scheduled date. This includes moving vehicles, removing personal property, and notifying any relevant HOA or building management before work begins.

You are also responsible for informing us of any underground utilities, irrigation lines, or other buried infrastructure in the work area. Arcadia Asphalt Paving is not responsible for damage to unmarked or undisclosed underground utilities.

7. Warranty and Workmanship

We stand behind our workmanship. Any warranty terms specific to your project will be stated in your written proposal. Warranty coverage is limited to defects in workmanship and does not cover normal wear and tear, damage caused by heavy vehicles beyond the project scope, soil movement or settling outside our control, or failure to perform recommended maintenance (such as sealcoating on schedule).

Warranty claims must be submitted in writing to info@arcadiaasphaltpaving.com within the warranty period. We will inspect and address valid claims within a reasonable timeframe.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Arcadia Asphalt Paving shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to our services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from services we perform shall not exceed the total amount you paid us for the specific project giving rise to the claim.

9. Warranty Disclaimers

Except as expressly stated in a written proposal, all services are provided "as is" and without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. Natural conditions such as ground movement, extreme weather, tree root activity, and UV degradation are outside our control and are not covered by any implied warranty.

10. Permits and Compliance

For projects that require a permit from the City of Arcadia or another local authority, we will advise you of the requirement and assist with the application. The cost of permits is the responsibility of the customer unless otherwise stated in the written proposal. Work requiring HOA approval is the customer responsibility to obtain before the scheduled start date.

11. Dispute Resolution

If a dispute arises between you and Arcadia Asphalt Paving related to our services or these terms, both parties agree to attempt to resolve the matter through good-faith direct communication first. Please contact us at info@arcadiaasphaltpaving.com to describe the issue.

If direct communication does not resolve the dispute, the parties agree to submit the matter to mediation before pursuing any legal action. If mediation fails, disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association, or in a court of competent jurisdiction in California.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action arising from these terms or our services shall be brought in the appropriate courts located in California.

13. Modifications to These Terms

We may update these Terms and Conditions from time to time. When we do, we will post the revised version on this page with an updated effective date. Continued use of our services or this website after changes are posted constitutes your acceptance of the updated terms.
